Canadian Wheat and Lumber Have Two Further Victories

After the firm's success on behalf of the Canadian lumber industry before a NAFTA Panel, the Government of Canada retained Steptoe as lead counsel in its effort to overturn a WTO panel decision ruling against Canada in a related aspect of the case. The WTO Appellate Body reversed the panel's decision.
Steptoe also won a major victory at the CIT for our lumber clients, as well as for the Canadian Wheat Board. The judge ruled, in our favor, that the Canadian producers had standing to sue and that Customs' application of the Byrd Amendment to Canadian goods was in violation of a provision of the NAFTA Implementation Act.
