Last week, the Ninth Circuit handed Scott Sinder a victory on behalf of Council of Insurance Agents & Brokers. The Ninth Circuit affirmed a decision holding Nevada's countersignature statute unconstitutional. Council of Insurance Agents & Brokers v. Molasky-Arman, No. 04-17271, -- F.3d --, 2008 WL 962103 (9th Cir. Apr. 10, 2008). The statute precluded licensed nonresident agents and brokers from finalizing insurance contracts without the countersignature of a resident agent. The panel ruled unanimously that the Nevada statute violates the privileges and immunities of nonresidents, in violation of Article IV. Congratulations to Scott and the Council on this victory. This is the third win by a Steptoe lawyer in a federal court of appeals in a single week.
