718 - THE UNSOLICITED
COMMERCIAL ELECTRONIC MAIL ACT OF 2001, was approved for Full
Committee consideration, amended, by a voice
vote.
The following
amendment was offered:
An
amendment in the nature of a substitute by Mrs. Wilson, No. 1,
(1) allows individuals and families to opt-out of the Unsolicited
Commercial Electronic Mail Act, (2) requires the valid reply address
of the sender of all unsolicited commercial electronic mail, (3)
allows Internet service providers to establish their own policies
about unsolicited commercial electronic mail, (4) prohibits
falsifying Internet routing information, (5) requires Internet
service providers who are specifically compensated for accepting
unsolicited commercial electronic mail to maintain an internal
opt-out list to protect their subscribers, (6) allows individuals
and Internet service providers to sue for the greater of actual loss
or $500 per violation up to $50,000, (7) provides the Federal Trade
Commission with cease and desist authority to protect individuals
and Internet service providers from senders of unsolicited
commercial electronic mail who do not honor opt-out requests or
violate the Internet service providers unsolicited commercial
electronic mail policies, (8) prohibits class action lawsuits, but
empowers State Attorneys General to bring suits on behalf of their
citizens, and (9) requires a study by the Federal Trade Commission
on the effectiveness of the Unsolicited Commercial Electronic Mail
Act, was AGREED TO by a voice vote.
