Please join us for Steptoe's Annual Regulatory Symposium on Thursday, November 30. At this hybrid event, we will discuss goals achieved, goals thwarted by the courts, and goals to be achieved by the regulatory agencies in the (last) year of the (first) Biden administration.
The administration's regulatory undertakings in the fields of energy, transportation, telecom, media and competition writ large are more than meets the eye, and more than could be expected in light of a Supreme Court apparently determined to erode doctrines of deference to the agencies and more narrowly circumscribe the space in which agencies may act.
But they are less than the administration hoped to achieve for a variety of reasons, including the longstanding lack of a fifth Commissioner in the FCC and FERC, and the antitrust agencies' mixed record in the courts.
We will discuss both the achievements and the disappointments, stark or partial, of the first three years and the lessons afforded by that experience for the fourth, or the next four, as we face another election cycle. How to succeed in business without trying is the surreal title of a comedy. In regulation, as in business, there are no free lunches. But how to succeed in the regulatory business and make your efforts count despite rather fierce headwinds will be our subject. We will discuss it with top regulators and policymakers, including Commissioner Mark C. Christie, one of the nation’s foremost experts on all things energy, and world-famous media public interest advocate and (Public Knowledge founder) Gigi Sohn, then with industry and experts through a series of breakout sessions inspired by input from you. What can industry do to explore and enlarge areas of possible win-wins and help the agencies achieve their goals? What can the agencies do to help themselves, including by coordinating among them? These are among the questions we will take up.
Our Fifth Annual Regulatory & Legislative Symposium will be offered as a hybrid event. Please indicate your preferred participation format (in-person or virtual) and breakout session selections on the registration form.
