The piece discusses net neutrality and the much-publicized theory that new Federal Communications Commission net neutrality rules are barred by the Supreme Court's recent decision in West Virginia et al v. Environmental Protection Agency.
Michalopoulos expresses the opposite view – that the West Virginia decision "slightly increases the chances that a net neutrality decision would survive a major questions review because it emphasizes that the major questions doctrine is not a major change."
