The Daily Dot quoted Pantelis Michalopoulos throughout a May 2 article titled “Could this Bill Kneecap the FCC’s Ability to Protect Net Neutrality?” The article discusses the No Rate Regulation of Broadband Internet Act, which was passed by the House in April.
Mr. Michalopoulos, who leads the firm’s telecom practice, agrees that, if the bill became law, it would create “a ripple effect of some uncertainty” and litigation. He expects many companies to seek to undermine the Federal Communications Commission’s open Internet rules if a rate-regulation ban took effect. “I can see an Internet service provider saying, in a blocking or throttling case, ‘My conduct, and the appropriateness of my conduct, should be evaluated … in light of an interpretative rule informed by this law.’ I don’t think they would succeed. But it might take years for us to find out that they will not succeed,” he says.
