Jack Hayes and Bo Yue have authored an article for Export Compliance Manager titled “The Long Arm of the EAR: Enforcement Authorities Beyond the US Expand.” The December 2020 article highlights how persons acting outside the US may be affected by US export control rules internationally, including reexports and transfers (in-country) of items subject to the Export Administration Regulations (EAR). The authors provide an overview concerning the US Bureau of Industry and Security’s (BIS) amendments to the EAR that significantly expand domestic and extra territorial export enforcement powers.
