Sunset Review Victory in Stainless Steel
June 23, 2005On June 21, 2005, Steptoe achieved a sunset review victory at the US International Trade Commission (ITC), when the ITC voted that an antidumping duty order, in place since 1999, should be revoked.
Steptoe represented the US and UK members of the Outokumpu stainless steel family in the sunset review of the AD and CVD orders against Stainless Steel Sheet and Strip from France, Germany, Italy, Japan, Korea, Mexico, Taiwan, and the United Kingdom. Outokumpu is a global stainless steel company and the only producer in the United Kingdom of stainless steel sheet and strip in coils.
Steptoe attorneys argued that because of unique products and company characteristics, the ITC should give the United Kingdom a decumulated analysis (not lumped together with the other countries involved) and be released from its AD order.
On a split vote, the ITC found no likely continuation or recurrence of injury by imports from the United Kingdom and France. Two commissioners voted to maintain all the orders, two commissioners voted to lift all the orders and two commissioners voted to lift the orders only as to the United Kingdom and France.
