Another Oracle Win

October 27, 2004

On October 21, 2004, the Cantonal Appellate Court in Geneva ruled in favor of Oracle Switzerland and Oracle Corp. in their long-running dispute with a terminated former senior executive based in Switzerland:  Falotti v. Oracle Switzerland.  At issue was Mr. Falotti's claim for a substantial amount of stock options that would have vested during a notice period to which he claimed he was entitled before his termination became effective under Swiss law.

Steptoe successfully represented Oracle in the declaratory action it filed in the US District Court for the Northern District of California and in subsequent appeals.  The instant case was filed by Mr. Falotti against Oracle's Swiss subsidiary.  Steptoe supervised the defense of the action in the Geneva Labor Court and on appeal.  The principal Steptoe lawyers involved were Ron Cooper, Morgan Hodgson, and Ellen McNamara.
