Law360 quoted Michael Allan in an August 20 article titled, “2nd Circ. Counterfeiting Ruling Boosts Brand Owners.” Mr. Allan commented on a recent ruling by the US Court of Appeals for the Second Circuit that the online sale of a single counterfeit item is enough to give a brand owner jurisdiction to file a trademark infringement suit. He told the publication, “The decision is an important tool in the battle against online counterfeiters…It makes it much more difficult for counterfeiters to run a nationwide operation on the Web and then throw up roadblocks like lack of jurisdiction.”
