Mark Silverman on Codification of the Economic Substance Doctrine at ABA Section of Taxation Webinar

Mark Silverman was a panelist on an American Bar Association Section of Taxation webinar titled “The Economic Substance Doctrine” on Wednesday, March 31, 2010. The Senate had passed a version of the extender’s bill (H.R. 4213) that contained a codification or "clarification" of the economic substance doctrine. This webinar examined what the proposed statutory language said and how it came about. The panelists also reviewed recent case law, including Coltec and Schering Plough, and discussed the impact on transaction planning.
