While most countries recognize the benefits of encryption technology (i.e., protecting the security, authenticity and integrity of communications), risks such as the potential for criminals and terrorists to conceal information regarding illegal behavior have led many governments to impose controls on the import, export, and/or use of encryption software, hardware, and technical information. Obtaining guidance on these regulations can be difficult, especially with regard to countries that do not publish their policies.
Complying with widely varying international encryption regulations remains a complex task with significant compliance risks, especially for multinational companies that require government licenses and approvals (e.g., financial institutions). And the cost of non-compliance can be significant. For instance, a violation of regulations related to the export of encryption may be punishable by substantial civil monetary penalties, denial of export privileges, confiscation of encryption software, and/or considerable criminal fines.
Our webcast provided information on the important role of encryption in corporate security and the evolving nature of data security threats. The speakers also covered country-specific encryption export and import licensing rules, best practices in global deployment, approaches to global licensing, and strategies for dealing with encryption regulations around the world.
As a special feature, Steptoe provided a demonstration of the Country-by-Country Guide to Encryption Regulations, a leading web-based resource on global encryption import, use, and export controls that provides information on encryption laws and regulations in more than 100 countries.
