Section 337 of the Tariff Act of 1930 is a powerful tool for enforcing U.S. intellectual property rights. In lieu of or in addition to an action in federal district court, a U.S. patent owner or other party experiencing unfair competition from imports may seek a remedy from the International Trade Commission (ITC). Section 337 provides for swift proceedings before an Administrative Law Judge, involving the usual discovery tools, motions practice and an evidentiary hearing. A panel consisting of a Supervisory Attorney from the ITC's Office of Unfair Import Investigations and two private practitioners will provide an overview of the statute and the procedural schedule for a Section 337 investigation. They will also address practice basics for the various phases of a Section 337 investigation, including the requirements of the ITC's Rules of Practice and Procedure.
