The EU Consultation on the Insurance Block Exemption

Ms. Eithne McCarthy, Project Leader from the Competition Directorate-General of the Commission, will discuss the consultation on the renewal of the Insurance Block Exemption (BER). We expect a useful, informative and lively discussion with our panel of speakers on key issues including:

  • A quick look at the use of the existing exemption: what have been the Commission’s and the industry’s experiences with the BER?
  • Information exchange in relation to pure premiums and standard policy conditions: what are the Commission’s intentions? Should the rules be maintained or improved to foster cooperation?
  • Insurance pools: does the exemption cover pro-competitive pools? Would non-renewal of the BER result in loss of capacity and coverage?
  • Legal certainty: merits of the block exemption in the context of modernisation of EC competition rules.

We will be asking the Commission speaker to clarify some of the questions raised in the consultation paper, the likely next steps and the expected timetable, and how insurers may respond and put forward their positions most effectively.
