Sara Beth Watson on Waste Streams Panel
February 22, 2005Sara Beth Watson is a panelist at the ABA Section of Environment, Energy and Resources' 34th Annual Conference on Environmental Law, held March 10-13, 2005, in Keystone, Colorado.
Her session, "Hidden Dangers?—Transportation & Management of Overlooked Waste Streams," addresses the jurisdiction and classification of often overlooked waste streams, like special wastes, universal wastes, waste oil and mixtures, and RCRA exempt oil and gas exploration and production wastes, which often present a special challenge to today’s environmental lawyer.
The panel assesses the unique issues associated with waste transportation, including homeland security and commerce clause issues, and discusses how the "all appropriate inquiry" standard applies to these materials when present in property transactions, which can result in CERCLA liability for managing these wastes, as well as other potential liabilities that may arise when these overlooked wastes demand attention.
