Why:  In the next administration, there will likely be unprecedented changes in labor legislation and key government appointments (e.g., NLRB, EEOC).  The Democratic agenda includes sweeping labor law changes to make it much easier for Unions to organize employees by doing away with secret ballot elections, meaning:

  • Under proposed legislation, Unions will be able to organize employees simply by producing signed “authorization cards” or through “quickie” elections based on signed cards; you will have little or no time to react;
  • With “organizing made simple” laws on the books, Unions will target many new and different types of employers without prior notice...no one will be immune from Union organizing;
  • Unions often organize a small department with only a few employees to get their “foot in the door.”

Conclusion:  Employers must change their Union-avoidance mindset from reactive to proactive. You must persuade employees now to say "No" to card-signing requests later (that you won't even know about).  This is key!
