Thomas M. Stanek is of counsel in the Phoenix office of Steptoe & Johnson LLP, where he is a member of the Litigation Department.
Employment Law and Litigation
Mr. Stanek counsels and defends businesses faced with claims of discrimination and/or harassment based on gender, disability, age, race, national origin and religion; as well as claims alleging breaches of contract, unfair labor practices, wrongful discharge, non-compete agreements, and other torts.
Mr. Stanek has represented clients in all aspects of labor relations including: successfully co-managing, pro-company union avoidance campaigns for multi-billion dollar companies facing an imminent threat of unionization; training supervisors on lawful methods to interact with employees; implementing training programs for employees to educate them about unions and their employers; working with management to improve employee morale and become more responsive to employee concerns and issues; investigating and litigating numerous unfair labor practice charges and labor arbitrations; counseling employers on lawful methods to respond to supervisors who were organizing for the union; preparing and defending witnesses before NLRB proceedings; and participating in all aspects of representation, objection to elections and unfair labor practice hearings.
Insurance Bad Faith and Commercial Litigation
Mr. Stanek advises insurers on coverage issues and represents them in declaratory judgment actions and civil litigation involving breach of contract, breach of fiduciary duty, bad faith, and punitive damage claims. Mr. Stanek also counsels and represents clients in complex commercial matters, such as business torts and contract disputes, with an emphasis on financial services.
Mr. Stanek has also supervised a team of lawyers and paralegals respond to an investigation conducted by the United States Department of Justice, Antitrust Division regarding the merger of two multi-billion dollar companies.
Prior to joining Steptoe, Mr. Stanek was a Law Clerk for the Honorable Frederick J. Martone of the Supreme Court of Arizona. His responsibilities included researching and preparing numerous memoranda regarding the proposed outcomes of cases, as well as proposed rule additions and amendments.
Noteworthy
- Entered and won numerous legal competitions and continues to actively participate in those competitions as a Moot Court judge at Arizona State University.
- Published an article in the Arizona State Law Journal, entitled "Photo Radar in Arizona: Is it Constitutional?"
