Scott Doyle is a partner in Steptoe & Johnson’s Intellectual Property group.  Mr. Doyle practices in the areas of intellectual property litigation, technology transfer, and global patent strategy. 

Mr. Doyle has been lead counsel in multiple litigations in courts throughout the United States, and has participated in all aspects of alternative dispute resolution, including arbitrations and mediations. In trying a complex case, he is successful at taking complex material and simplifying the presentations of both law and technology to the bench and to a jury.  He is also skilled at developing strategies for resolving disputes.  He has litigated cases including a wide range of technologies including interactive television systems, VOIP telephony, software, wireless devices, photolithography machines, set top box technologies, telecommunications, dental bonding compositions, blood oxygenators, iron magnets, bar scanning devices, amongst others. He managed a patent litigation case for ACTV, Inc. against the Walt Disney Co., resulting in a claim construction victory for ACTV at the Court of Appeals for the Federal Circuit.  He was also a member of the team representing Nikon in a patent litigation suit against ASML.  The matter was resolved with a  $145 million payment to Nikon.

As an electrical engineer prior to practicing law, he helped design and develop next-generation military satellite and terrestrial communications systems. 

Representative Matters

Representative Litigation

  • Verizon v. Vonage (Court of Appeals for the Federal Circuit & E.D. VA) – Co-lead Counsel, tried case in district court for Vonage and represented company on appeal in its patent infringement case brought by Verizon Communications, Inc. Case has settled.
  • Macrovision Corporation v. Motorola, Inc. (N.D. of California) – Co-Lead Counsel, represented Motorola against Macrovision in patent and contract disputes involving analog copy protection technology.  Settled favorably prior to trial. 
  • Vonage v. Nortel et al. (N.D. Tex. & D. Del.) - Lead Counsel, in multiple patent cases where Nortel was asserting 12 patents against Vonage and Vonage was asserting 3 patents against Nortel and others.  Cases settled with no exchange of money and cross licenses.
  • IPT v. Motorola, Inc. (N.D. of Illinois) – Co-Lead counsel, represented defendant Motorola in patent case involving four patents.   Settled favorably prior to trial. 
  • Vcode v. Aetna, et al. (D. Minn.) – Lead Counsel, representing defendant Aetna.  Successful in obtaining a stay from the court while patents are in reexamination at the US Patent Office. 
  • Ronald Katz Licensing v. Amtrak et al. (E.D. Tex.) - Lead Counsel, representing Amtrak in patent case relating to automatic telephone call processing technology.  Case settled favorably.
  • REM v. Risk Assessment Solutions, et al. (Circuit Court, Arlington, VA) – Lead Counsel, representing defendants in disputes involving ownership of IP assets, breach of contract, amongst other claims.  Successful in getting plaintiff to voluntarily dismiss the action with no payment by defendants.
  • Nikon v. ASML et al., (N.D. of California). Represented Nikon in major photolithography case.  Payment of $145 million to Nikon
  • Software AG v. BEA, United States District Court. Represented BEA Systems against Software A.G., including the defense of an action for patent infringement in the District of Delaware, the assertion of infringement claims against Software A.G. in the Eastern District of Virginia, and the successful initiation of reexamination proceedings before the United States Patent and Trademark Office, leading to a settlement of all litigation.
  • MIT v. Peak Audio, United States District Court. Lead Counsel, represented defendant in patent infringement action involving Ethernet Networked Audio Technology, settled prior to trial with a cross license. 
  • ACTV, Inc. v. The Walt Disney Company, Court of Appeals for the Federal Circuit, United States District Court. (Managed litigation as in–house counsel resulting in a victory at the Federal Circuit on claim construction.) 
  •  Intermec v. Symbol Technologies, United States International Trade Commission. Represented petitioner Intermec in Section 337 litigation involving bar code patents
