Steven J. Barber is a litigation partner in the Washington office of Steptoe & Johnson LLP. He is a member of the Technology and Litigation Departments.
With substantial first chair trial experience in jury, bench and administrative trials, Mr. Barber represents individuals and corporations in state and federal court litigation concerning alleged patent infringement, trademark dilution, trademark infringement, and unfair business practices. He is currently co-lead trial counsel in a cutting-edge patent infringement suit involving VoIP technology.
In addition to litigating Section 337 trademark and technology-related patent cases before the US International Trade Commission, Mr. Barber litigates copyright infringement cases, and advises clients on registration and enforcement of copyrights, including Customs enforcement.
Internet Service Providers
Mr. Barber litigates and counsels clients on commercial and intellectual property disputes with an emphasis on representing Internet service providers (ISPs). He advises ISPs on compliance with the Digital Millennium Copyright Act (DMCA), including the DMCA’s notice and take down procedures, information subpoena requirements, and rights management provisions. He also counsels ISPs on peer-to-peer file sharing technologies, trademark infringement and trademark dilution claims, copyright infringement claims, defamation claims, and potential liability arising from online auctions and other e-commerce activities.
Internet Domain Names
Mr. Barber represents domestic and foreign clients in Internet domain name litigation concerning claims for alleged cybersquatting, trademark infringement, trademark dilution, and unfair business practices. Mr. Barber’s domain name cases frequently include parallel proceedings under ICANN’s Uniform Domain Name Dispute Resolution Policy. He counsels clients on website linking agreements, and domain name and Internet Protocol address registration and transfer matters, including international domain name registrations, domain name transfer procedures and documentation, and ARIN’s Internet Protocol address registration and transfer procedures.
Other Internet and Technology Matters
Mr. Barber advises Internet-based companies on patent infringement claims, privacy disputes, privacy policies, encryption technologies, and data security. He also litigates breach of contract and other commercial claims on behalf of technology companies.
