John Mogg is of counsel in the Washington office of Steptoe & Johnson LLP, where he is a member of the Litigation Department. Mr. Mogg is a magna cum laude graduate of Harvard University with a degree in economics, and a graduate of Yale Law School.
Mr. Mogg’s practice covers a wide variety of complex litigation in all stages of the litigation process from discovery to trial.
Mass Tort And Products Liability
Mr. Mogg’s practice focuses on mass tort and toxic tort liability. He is a member of the national defense litigation team managing thousands of tort claims filed against a major corporation related to the company’s research, publication, and investigative efforts concerning asbestos, silica, and welding fumes. Mr. Mogg also handles products liability cases.
As part of his responsibilities in these matters, Mr. Mogg manages complex discovery disputes and document productions, handles numerous depositions, authors dispositive motions, and resolves matters related to settlement and dismissal of cases. Mr. Mogg’s dispositive motions practice has resulted in the dismissals of thousands of claims for one client over the past six years. Mr. Mogg also has been a key member of several trial teams, managed various aspects of trial, including pre-trial filings, and tried cases to verdict.
Insurance Coverage And Commercial Litigation
Mr. Mogg’s practice also includes cases related to insurance coverage disputes and other commercial matters. In these cases, Mr. Mogg has been responsible for the management of discovery, production of voluminous documents and the resolution of a number of complex issues. Mr. Mogg also resolves settlement issues with regards to these matters.
Investigations
Mr. Mogg has also been involved in a number of internal investigations. Some have involved assessment of liability related to internal corporate practices; others have involved antitrust matters. During these investigations, Mr. Mogg’s responsibilities included handling several interviews of high level executives, management of document productions, and recommending appropriate courses of action. Mr. Mogg has also participated in White Collar matters.
Appellate And Constitutional Litigation
In addition to his trial-related work, Mr. Mogg has significant experience drafting appellate briefs and arguing appeals. Bringing his experience as a clerk for the U.S. Court of Appeals for the Ninth Circuit to bear, Mr. Mogg has briefed and argued constitutional issues before numerous courts of appeals and state supreme courts. Mr. Mogg’s appellate cases have also involved products liability and tort issues.
Mr. Mogg is currently litigating a case in federal court involving Commerce Clause and Contract Clause attacks on state statutes.
Commitment To Pro Bono
For several years, Mr. Mogg has represented a District of Columbia non-profit organization dedicated to helping intellectually disabled adults in a variety of successful trial and appellate matters. These cases have included issues related to discrimination, wrongful termination, contract, and insurance claims. Mr. Mogg has also represented indigent clients in family law matters. One such case involved the successful defense of a trial verdict in his clients’ favor in the District of Columbia Court of Appeals.
Previous Experience
Prior to joining Steptoe, Mr. Mogg served as a coordinator for the successful re-election campaign of a member of the U.S. Congress, and as a law clerk to the Honorable Kim McLane Wardlaw.
While at Yale Law School, Mr. Mogg was involved in student government and served as Chair of the Student Representative Council. He was also a member of various Journals, including the Yale Law Journal and the Yale Journal of International Law.
Mr. Mogg has been a member of a number of firm committees, including the Hiring and Professional Training Committees. As part of his responsibilities, Mr. Mogg has led several presentations to other attorneys at the firm regarding brief writing, discovery, and internal investigations.
