Mark A. Moran is a partner in the Washington office of Steptoe & Johnson LLP, where he is a part of the firm's international practice group. His practice centers on international trade litigation, counseling domestic and foreign clients on various trade policy issues and international arbitration.
International Trade
For 20 years, Mr. Moran has successfully litigated numerous high-profile import relief cases under the US anti-dumping, countervailing duty, and safeguards laws. He is an accomplished oral advocate, and routinely acts as “first chair” counsel in proceedings before all of the US agencies that administer the trade laws, including the International Trade Commission, the Department of Commerce, and the Office of the United States Trade Representative. He also prosecutes appeals from these agencies to the Court of International Trade, Court of Appeals for the Federal Circuit, and binational dispute settlement panels established under the NAFTA. He has an active WTO practice, having advised governments and private sector clients in more than 15 WTO dispute resolution proceedings, and is among the very few private lawyers ever to have argued (successfully) before the WTO Appellate Body.
Recently, Mr. Moran has acted as lead counsel to the Canadian industry in the anti-dumping and countervailing duty cases against imports of softwood lumber from Canada, the most commercially significant trade cases ever filed under the US trade laws. Mr. Moran’s advocacy in the NAFTA proceedings led to the reversal of the International Trade Commission’s injury decision, one of a handful of times the Commission has ever been reversed on appeal in the 27 years it has been deciding cases. He also recently won an important case of first impression at the Court of Appeals for the Federal Circuit involving the proper application of injury and causation standards under the antidumping and countervailing duty laws.
Mr. Moran also advises domestic and foreign corporations, trade associations, and foreign governments on a wide range of trade policy issues. These include planning and implementing lobbying campaigns to secure access to the US market, negotiation of suspension agreements under the US trade laws, interpretation and analysis of WTO agreements, and developing negotiating objectives in bilateral and multilateral trade negotiations. He also assists multinational corporations in developing and implementing international trade and investment strategies.
International Arbitration
Mr. Moran’s international arbitration experience has its roots in one of the largest and most complex cases litigated before the US-Iran Claims Tribunal, where the firm prosecuted claims in excess of $1 billion on behalf of a consortium of US oil companies. Since then, he has advised and represented clients in connection with arbitrations under the leading institution rules, including the International Chamber of Commerce, the Stockholm Chamber of Commerce, the American Arbitration Association, and the London Court of International Arbitration. He also has acted as counsel in ad hoc arbitrations under the UNCITRAL Rules, including before the Cairo Regional Centre for International Commercial Arbitration.
Mr. Moran’s arbitration cases have involved claims stemming from turn-key construction projects, oil and gas concession agreements, aircraft services agreements, real estate development projects, telecommunications joint ventures, large-scale electric power projects, and international commodity trading.
