Viet H. Ngo is of counsel at the Washington office of Steptoe & Johnson LLP, where he is a member of the Regulatory & Industry Affairs Department. He focuses on electric utility regulation, with an emphasis on restructured electricity markets.
Mr. Ngo represents and advises electric power companies before the Federal Energy Regulatory Commission (FERC) in a broad range of matters relating to electric utility regulation and deregulation, including electric utility and power pool restructuring; mergers, acquisitions, and divestitures; market power issues; contract disputes; and transmission pricing and access. He regularly assists public utilities and their non-regulated affiliates in antitrust, regulatory, and other legal matters arising from the non-regulated businesses. He also regularly advises electric utility clients on compliance issues relating to FERC’s Code of Conduct and Standards of Conduct.
Over the past several years, Mr. Ngo has been actively working on corporate and power pool restructuring matters and regional transmission organization (RTO) and independent transmission coordinator proposals in response to federal and state industry restructuring initiatives. He has also been involved in litigating transmission and power contract disputes related to the restructured electricity markets, such as cost responsibility for transmission congestion charges under locational marginal pricing. In addition, Mr. Ngo has acted, as FERC regulatory counsel, in several major generation sale transactions in the Northeast.
Mr. Ngo has a Bachelor of Science in electrical engineering (with an electric power specialty). Prior to law school, Mr. Ngo worked as an engineer for a major US investor-owned utility. Mr. Ngo also worked for NASA Langley Research Center.
