William Bosch is a partner in the Washington office of Steptoe & Johnson LLP, where he is a member of the Litigation and Technology Departments. Mr. Bosch concentrates his practice on complex litigation, with a particular emphasis on issues involving intellectual property and commercial disputes.
Mr. Bosch has substantial trial experience, both in a first-chair role and as part of a larger trial team, where he often is asked to cross-examine the most challenging fact and expert witnesses. Given his background handling intellectual property and commercial disputes, the issues Mr. Bosch regularly handles are many and varied, and often involve allegations of IP infringement (patent, copyright, and trademark), trade secret misappropriation, false advertising, unfair competition, breach of contract, fraud, breach of fiduciary duty, or civil RICO.
Representative intellectual property engagements handled by Mr. Bosch include:
- Defended damages case for Vonage in a three-week jury trial in the Eastern District of Virginia involving seven patents; jury rejected plaintiffs’ damage claims.
- Represented xWave Technologies in the successful defense of a trade secret misappropriation case involving software in the Eastern District of Virginia; court required plaintiff to post bond to pursue claims, settled before client’s summary judgment motions were heard.
- Represented Exide in rejecting a trademark license as "executory" under the Bankruptcy Code; court rejected testimony of challenger’s brand experts following cross-examination and concluded that balance of hardships weighed in Exide’s favor. See In re Exide Technologies et. al., 340 B.R. 222 (D. Del. 2006).
- Represented Priceline in a trade secret misappropriation matter against a major software and information technology company.
- Represented Image Telecommunications Corp. in the Eastern District of Virginia in defense of a patent assignment dispute involving video on demand technology.
- Represented Arxx Building Systems (f/k/a AAB Building Systems) in a patent and trade secret dispute in the Northern District of Georgia.
- Represented Medtronic AVE in defense of willful infringement claims in high profile stent patent litigation wars.
- Represented Amazon.com in the successful pursuit of domestic and overseas claims against a cybersquatter.
- Represented Warner-Lambert in an in rem proceeding against a cybersquatter in the Eastern District of Virginia.
- Represented Rio Grande Foods in defense of trademark and trade dress infringement claims in the Eastern District of Virginia
- Represented LaSalle Hotels in defense of trademark infringement and dilution claims in the Southern District of New York.
- Represented Fisher-Price in copyright infringement claims against a toy manufacturer in the Northern District of New York.
Mr. Bosch’s trial experience and numerous counseling engagements in these varied substantive areas lends itself to formulating creative and effective dispute resolution strategies for a broad array of commercial concerns, including high-tech and general research, development and manufacturing businesses, consumer products companies, intellectual property owners, on-line marketplaces, and financial services companies.
Mr. Bosch also maintains an active pro bono practice representing veterans and their families.
