Steptoe partners Matt Herrington and Mike Miller authored an article for the New York Law Journal titled “Judiciary Law §487: Potency Of Claims Has Grown Since ‘Amalfitano.’” The article, published on September 29, provides an analysis of a sampling of Section 487 case pre and post Amalfitano, the 2009 ruling from the New York Court of Appeals that held that an attorney who attempts to deceive the court is subject to treble damages, despite the fact that the deceit is unsuccessful.
