North Korean Company Sanctioned for Missile Proliferation Activities; OFAC Revises the List of Specially Designated Nationals

This is a general advisory regarding developments on US sanctions implemented by the US Department of State and the US Department of the Treasury, Office of Foreign Assets Control ("OFAC").  First, the State Department has ordered sanctions against a North Korean entity for missile proliferation activities.  Second, there have been a number of changes by OFAC to its list of blocked persons and entities.  We have summarized those changes for you below.

The State Department Imposes Missile Proliferation Sanctions on a North Korean Company

A Federal Register notice issued August 23, 2002, confirmed press reports that US sanctions have been imposed on a North Korean company, Changgwang Sinyong Corporation.1  The sanctions, effective August 16, 2002, ban exports of equipment and technology related to missiles and missile development as designated by the Missile Technology Control Regime ("MTCR") for two years.  Please click here for the Federal Register notice.

The State Department imposed the sanctions following a determination that the company has been engaging in missile technology proliferation activities that violate the Arms Export Control Act and the Export Administration Act.  The sanctions include not only a two year ban on exports of MTCR-controlled items to Changgwang Sinyong Corp., but also a ban on sales of these items to the Government of North Korea.

State Department officials have noted that they do not know of any US companies engaged in business with Changgwang Sinyong Corp.  However, the imposition of these sanctions should alert companies that the US government is paying close attention to the North Korean weapons research and production activities.  Further, this decision represents the fourth major announcement of nonproliferation sanctions this year.  Additional companies involved in proliferation activities are likely to be identified in coming months.

OFAC Adds and Subtracts Individuals and Companies from the List of Specially Designated Nationals
