International Law Advisory - OFAC WMD Trade Controls

This is to advise you that on Tuesday, September 21, 2004 the Department of Treasury, Office of Foreign Assets Control, updated its list of those subject to the import ban of the Weapons of Mass Destruction Trade Control.  This ban, effective since 1998 under an amendment to Executive Order 12938, restricts imports from those individuals determined by the Secretary of State as having engaged in activities related to the proliferation of weapons of mass destruction.

The list has been updated to include the following entity:

• Xinshidai (a.k.a. China New Era Group; a.k.a. China Xinshidai Company, a.k.a. New Era Group; a.k.a. XSD)

Companies should update their OFAC compliance screening mechanisms to ensure that any existing business relationships or transactions, and any relationships or transactions in the future, are in compliance with OFAC regulations.
