Dylan Ruga authored an article entitled "Performance Anxiety," featured in the July 7, 2009 issue of the Los Angeles Daily Journal. In the article, he discusses The American Society of Composers, Authors and Publishers (ASCAP) current dispute with AT&T over whether a public performance occurs when ringtones are downloaded on cellular phones and other mobile devices. The ASCAP case will be strongly based on the outcome of Cartoon Network LP LLLP v. CSC Holdings Inc., 536 F.3d 121 (2d. Cir. 2008), which claims that a public performance takes place every time a "Remote Storage Digital Video Recorder," or a RS-DVR recording is made.
