Law360 quoted Sara Pikofsky in a November 9 article titled "'Church Plan' Cases After Advocate Health: A Cheat Sheet." The article discusses the impact of the US Supreme Court's Advocate Health Care Network decision that extended the Employee Retirement Income Security Act's (ERISA) religious exemption to benefit plans maintained by church affiliates. More than a year after the decision, lower courts continue to grapple with exactly what the ruling means for so-called church plans.
However, Pikofsky tells Law360 that she hasn't seen a lot of new cases filed over church plans. "To me, one of the bellwethers of whether a litigation trend is still viable is whether plaintiffs lawyers are seeking new plaintiffs to bring new class actions to bring similar claims."
