Overview
(September 19, 2017, Washington, DC) — Steptoe & Johnson LLP is pleased to announce that Lucinda Low has been appointed to serve on the International Centre for Settlement of Investments Disputes (ICSID) Panel of Arbitrators. Ms. Low is one of ten lawyers named to the panel and the only one from the United States.
World Bank president and chair of ICSID's administrative council Jim Yong Kim designated the lawyers to a roster from which ICSID can select when called upon to exercise its appointing functions in ICSID cases. The addition to the centre's panels of arbitrators is the first time Mr. Kim exercised his power to do so under the ICSID Convention. The appointees, including newcomers and some who have previously appeared on ICSID tribunals, became effective on September 16. The designation is for a six-year period extending through September 16, 2023.
In July, Ms. Low was appointed the president of an ICSID tribunal panel hearing a billion-dollar claim by the Viennese arm of Italian banking group UniCredit against Croatia over legislation that converted loans and mortgages denominated in Swiss francs to euros. In 2016, she became the presidential appointee to the Panel of Conciliators of ICSID.
At Steptoe, Ms. Low heads the firm's Compliance, Investigations, Trade and Enforcement Department and is a member of the management committee. Over the course of her legal practice, she has been involved in AAA, ICC, LCIA, ICSID, and other institutional and ad hoc arbitrations. She was one of the first US lawyers to argue a claim before the Iran-US Claims Tribunal. Her arbitration experience encompasses representation of investors and host states, as well as service as an expert witness and as an arbitrator. Ms. Low currently serves on the US Department of State’s advisory committee on Public International Law, and as the president of the American Society of International Law.
