The article explains why the European Commission (EC) will have to examine the utility of resale price maintenance (RPM) in its upcoming review of the vertical restraints rules and contend with diverging practices in the United States. Some lawyers flagged RPM as a key issue in the review, pointing to the fact that it is allowed in the United States and that it is valued by luxury brands challenged by "free riding" e-commerce websites.
"In contrast with the US, the EU has never been lenient on RPM," says Botteman. On price restraints in general, the EC is in a "very dogmatic position," he adds.
