Politico Morning Tax quoted Elinor Ramey in a May 27 article titled "Final Rules Out on Ending Big Money Disclosure for Many Tax Exempts." The article discusses new regulations from Treasury and the IRS on executive compensation for nonprofit organizations. Though Treasury and the IRS took into account related organizations, they didn't consider the specific structure of a foundation with a related corporation in which employees of the corporation may be officers of or provide services to the foundation, even if the foundation doesn’t pay any compensation for the services.
Ramey, who was involved in the guidance as part of Treasury's Office of Tax Policy, says, "This is just an issue that wasn't thought about initially."
