Securities Regulation Daily covered a June 18 webinar presented by Steptoe partners Stacie Hartman and Charley Mills titled "The CFTC's Enforcement Manual: Key Content and Use for Practitioners in CFTC Investigations." The webinar, hosted by FIA's Law & Compliance Division, discussed how the Commodity Futures Trading Commission's (CFTC) manual fits in with the Division of Enforcement's broader efforts to provide guidance to the industry and promote self-reporting and cooperation with its investigations. In May, the CFTC's Division of Enforcement made its Enforcement Manual generally available for the first time in the agency's history. That initiative was part of an effort to provide greater transparency to the public, with the intent to increase certainty and consistency as well.
While neither Hartman nor Mills saw the Enforcement Manual as providing any big surprises, both found it to be a useful document for an attorney representing parties that might have issues with the Division of Enforcement. According to Hartman, the manual provides a roadmap for discussions with staff. Meanwhile, Mills described the manual as "a tremendous resource for practitioners." In particular, he found the description of the organization and its various units to be particularly helpful.
