Law360 Quotes Jennifer Quinn-Barabanov on Whirlpool Class Action Trial

Steptoe partner Jennifer Quinn-Barabanov was quoted in a Law360 article titled “Whirlpool Washer Trial To Hinge On Common Defect Question.”  The article, published on October 6, discusses the class action trial involving Whirlpool Corporation’s allegedly defective washers.  The class claims that over an 8 ½ year period, Whirlpool sold 20 front-loading washer models with mold-producing defects.  The class includes members who have experienced varying levels of mold, including some members who have not suffered mold problems at all.  The certification of the class has been considered at least twice by the US Court of Appeals for the Sixth Circuit and once even acknowledged by the US Supreme Court.  

"When defendants are faced with broad classes like this that include people who have never experienced a problem with the product, it makes settlement more difficult and creates significant pressure to try at least some of these cases," Ms. Quinn-Barabanov says.  "There has been some chatter in the defense bar about whether companies are now going to choose to try more of these cases."
