Harris Martin Publishing covered Steptoe’s win for CRC industries a January 27 article titled “Trial Court Judge Throws Out Benzene Case; Rules Testimony from Sloan Kettering’s Chief of Myeloma Service Inadmissible.” The article discusses the decision by Judge Rolf Treu of the California Superior Court for Los Angeles County to grant an in limine motion authored by Steptoe lawyers Lawrence Riff and Jennifer Bonneville that challenged the testimony of C. Ola Landgren, M.D., Ph.D – the chief of Myeloma Service at Memorial Sloan Kettering Cancer Center –– on Jan. 26 just before jury selection in the trial was slated to begin.
Judge True found that Steptoe’s position on behalf of CRC – that illustrated “a huge analytical gap between the basis of Dr. Landgren’s opinion and his ultimate conclusion” – had merit, and thus, excluded the expert testimony. With no other expert testimony to offer, the plaintiffs’ counsel declined to go forward with the case, and the lawsuit was dismissed with prejudice.
