Law360 quoted Pantelis Michalopoulos in a September 13 article titled “FCC Walking Fine Line With Station Ownership Move.” The article discusses why the Federal Communications Commission (FCC) will likely be forced to defend its decision to eliminate a key break in the way it calculates restrictions on media ownership.
Mr. Michalopoulos says he believed the FCC would likely prevail in a court challenge and has the authority to change the methodology for calculating the cap. "There is a congressional statement on this: there needs to be a 39 percent national reach limit. And so the FCC was not really empowered to change that, but I do believe that the agency has discretion to modernize the methods for calculating that."
