One question is the role climate change should play in NEPA reviews. The Obama administration issued guidance on climate change when conducting NEPA reviews that was rescinded when President Trump signed an executive order on energy issues, leaving a gap that parties and courts will have to figure out.

Ms. Taub tells Law360: “It’s a difficult issue for agencies to get their arms around because it’s hard to say what the impact of one federal action is going to be vis-a-vis climate change. Will the Trump administration come out with their own guidance? Or will they withdraw other, past CEQ guidance?”
