Steptoe & Johnson LLP Launches Construction Mediation Practice

Experienced Practitioners Find Innovative, Cost-Effective Approaches to Mediate Disputes
July 14, 2010

(July 14, 2010, Washington, DC) – Steptoe & Johnson LLP, a leading international law firm, today announced the launch of its Construction Mediation practice.

Leading the practice is Steptoe of counsel Mike Bergeron, the Operations Director of Steptoe’s Complex Litigation and Discovery Center. Mr. Bergeron has handled all phases of construction dispute resolution including mediation, Dispute Review Boards, litigation, and labor grievances including claim preparation, presentation, defense, and settlement. He brings nearly 30 years of experience as a senior construction executive, including serving as Chief Counsel for an international public building contractor and as an assistant project manager on Boston’s Big Dig.

“The mediation approach to dispute resolution allows the parties to create innovative and flexible solutions—not typically available through litigation—that may save disputants significant time and money,” Mr. Bergeron said. “In launching this service, Steptoe recognizes the growing demand in the construction industry by contractors, owners, architects, and engineers for mediators who have real industry experience, speak the language, and understand the nuances. By participating in a less conflict–laden process, many times the parties can maintain an ongoing business relationship while working to resolve their differences.”

Mr. Bergeron’s construction background includes managing and resolving more than 100 lawsuits, and handling more than 20 Dispute Review Board hearings, mediations, and numerous labor grievance hearings. Utilizing the Harvard Mediation Workshop–endorsed “interest–based” approach, Mr. Bergeron and his team determine the parties’ core interests in rendering a resolution that satisfies all parties.
