Steptoe’s Air Quality & Climate Change Group has experience in compliance counseling as well as representing clients in regulatory proceedings and litigation regarding the Clean Air Act (CAA). 

Steptoe is actively engaged in climate change issues on the both the regulatory and legislative fronts.  We assist clients with the developing regulatory requirements on greenhouse gas emissions, including EPA’s “Tailoring Rule” for stationary sources.  With a substantive and bipartisan government affairs practice, Steptoe is uniquely positioned to help companies frame the discussion and shape the policy outcome on climate change. 

Steptoe has assisted a wide array of clients with a variety of air quality and climate change issues, including:

  • Assistance with conformity reviews under the CAA, often in conjunction with NEPA reviews
  • Advice on complex permitting issues, including best available control technology (BACT) for CO2 emissions
  • Compliance counseling on the CAA’s Renewable Fuel Standard (RFS) program, including Renewable Identification Number (RIN) transactions and EPA reporting requirements
  • Advice on complex issues surrounding carbon sequestration and enhanced oil recovery (EOR)
  • Handling complex CAA litigation, including preemption challenges to state gasoline content regulations
