With more than 15 years of experience and a dual qualification in France and the UK, Jean-Nicolas Maillard focuses on EU and French competition law.  He advises clients across the whole spectrum of antitrust law and compliance.

He has extensive experience in handling “dawn raids” and in devising creative and tailor-made defense and/or cooperation strategies in cartel and antitrust investigations.  Highlights of his work in this area include:

  • Assisting multinational clients in fourteen European Commission (EC) and French Competition Authority dawn raids and related litigation (including the successful annulment of a dawn raid by the French Courts)
  • Securing full immunity for clients in five leniency procedures at the EC and French Competition Authority
  • Defending clients in numerous antitrust investigations from the French Competition Authority and resolving challenges from the regulators through the negotiation of commitments in two major cases

Mr. Maillard also regularly represents companies in antitrust court litigation, sectoral investigations, and abuse of dominance matters.  He regularly organizes, implements, and manages antitrust compliance initiatives with in-house teams, including risk-mapping and comprehensive antitrust audits. 

In addition, his M&A experience includes advising industry clients, services groups and investment funds in relation to over 100 corporate transactions (mergers, acquisitions, hostile takeovers, disposals, joint ventures) and obtaining merger control clearances from the EC, the French Competition Authority, the UK competition authorities, and other national competition authorities throughout the world in a large number of strategic corporate transactions.  He also works closely with suppliers on all issues connected to the distribution of their products and services.

Throughout his career in Paris, London and Brussels, Mr. Maillard has gained significant exposure to a wide range of business sectors, including food, retail, consumer electronics, financial services and private equity, construction products, agriculture, and pharmaceuticals.

  • Defending a rail maintenance group in a French bid-rigging case
  • Assisting an international group in the European Commission freight forwarding investigation
  • Representing a major flour producer in French antitrust investigations and related litigation and obtaining the annulment of the dawn raid as well as a positive resolution of the case
  • Counselling several international food groups in various in-depth antitrust investigations by the French Competition Authority
  • Representing a major consumer electronics group in its antitrust defence against a standard essential patent action introduced by a competitor in France
  • Advising an international healthcare client on complex vertical resale price maintenance issues
  • Carrying out in-depth audits and analysis of the anti-competitive practices of a large conglomerate in France
  • Defending a major consumer electronics group in an interim measure case and commitments procedure relating to the structure of its distribution
  • Advising a payment card group in relation to a French procedure on their multilateral interchange fees and resolving the case through commitments
  • Representing a large pharmaceutical company in relation to the European Commission pharmaceutical sector investigation
  • Counselling an international group in relation to several French sector inquiries into (i) electronic commerce, (ii) online advertising and (iii) internet peering agreements
  • Representing a major software group in several abuse of dominance investigations by the UK Office of Fair Trading
  • Assisting a financial institution in an extensive antitrust risk mapping exercise
  • Successfully advising the largest European veal producer in its acquisition of the largest French veal producer
  • Obtaining unconditional clearance in Phase I from the European Commission in the acquisition by a major European shipbuilder of another European shipbuilder in adverse conditions
  • Assisting a major European spirits group in the negotiation of its worldwide merger with a major competitor
  • Advising a major industry group in the preparation of a hostile takeover
