Mr. Parkhurst has litigated many intellectual property disputes, including patent, trademark, trade dress, and copyright infringement allegations, and patent/antitrust claims, in US district and appellate courts over several decades. He also has successfully litigated inter partes reviews (IPRs) and patent interferences before the USPTO Patent Trial and Appeal Board. He has written hundreds of patent infringement/validity opinions, and has counseled many enterprises on policies and strategies for protecting their intellectual property. He has acted as an expert witness in patent infringement and patent/antitrust cases. He also is an able neutral, certified in mediation by the Harvard Negotiation Institute.

Roger is recognized by his peers as a leading member of the intellectual property bar. He served as president of the American Intellectual Property Law Association from 2001-2002.  

Representative Matters

  • Acted as lead counsel for opposer in International Spirit Brands Ltd. v. Kalaris, (TTAB 2016), and ultimately negotiated favorable settlement for opposer.
  • Acted as lead counsel for appellant Mobis in Hyundai Mobis Co. Ltd. et al v. Autoliv ASP, Inc., in Federal Circuit appeal of an IPR decision and authored appellate brief.
  • Won PTAB final written decision in another IPR, Hyundai Mobis Co. Ltd. et al v. Autoliv ASP, Inc., holding all challenged claims unpatentable.
  • Acted as lead counsel for Mobis defending patent infringement suit in Autoliv ASP, Inc. v. Hyundai Mobis Co., Ltd. and Mobis Alabama LLC, M.D. Ala. (2013), successfully stayed case until final appellate decisions in two IPRs.
  • Acted as lead counsel for plaintiffs in Roger Cleveland Golf Co., Inc. and Dunlop Sports Co. Ltd. v. Callaway Golf Co., C.D. Cal. (2013); trademark infringement/unfair competition case settled favorably for plaintiffs.
  • Acted as lead counsel for plaintiffs in SRI Sports Ltd. and Roger Cleveland Golf Co., Inc. v. Golf Network et al., C.D. Cal. (2012); settled 15 USC § 1125(a) )[§ 43a] unfair competition case with stipulated injunction against all defendants.
