Why ‘Exporting’ US Copyright and Communications Law Through Trade Agreements is a Good Idea

May 11, 2015

Markham Erickson authored an article for the American Enterprise Institute's TechPolicyDaily.com titled “Why ‘Exporting’ US Copyright and Communications Law Through Trade Agreements is a Good Idea.”  The article discussed how US Trade policy should be updated to include key US copyright and communications laws that have been critical to the growth of the Internet industry in the United States.  Specifically, Mr. Erickson called for inclusion of fair use-like principles from the Copyright Act and Section 230 of the Communications Decency Act.  He noted that USTR has taken the first step in proposing fair use-like language in the Trans Pacific Partnership, and Congress should take the next step on including Internet-friendly provisions in Trade Promotion Authority legislation.
