Steve Adkins and Matthew Bathon authored an article for the State Bar of Michigan’s Intellection Property Law Section Proceedings titled “Not Mere Litigation: Using the ITC When Infringing Products Have Already Been Imported or Not All of the Importing Competitors are Known.” The article examines how a Section 337 proceeding can be used to enforce intellectual property rights against infringing importers and how working with Customs permits a more customized remedy to stop further importation of infringing goods than is available in district courts.
