A New Basis for CERCLA Liability?

Steptoe associate Christopher Smith, based in the firm’s Los Angeles office, authored an article for the Daily Journal titled “A new basis for CERCLA liability?”  The article discusses Pakootas v. Teck Cominco Metals Ltd., where the US Court of Appeals for the Ninth Circuit has scheduled oral argument for April 6 to consider a novel legal theory involving whether deposition of hazardous substances from air emissions should be exempt from liability under the Comprehensive Environmental Response, Compensation, and Liability Act, aka CERCLA.
