The ITC: Brand Protection Outside the Box

Managing Intellectual Property magazine featured an article written by Steptoe partner Michael Allan on March 27.  The article, titled “The ITC: Brand Protection Outside the Box,” discusses how the International Trade Commission (ITC) can be a forum for a wide variety of intellectual property disputes beyond patent infringement.  Mr. Allan explains how the ITC, under Section 337, can investigate a number of unfair methods of competition, including trademark infringement, copyright infringement, and trade secret misappropriation.  The article further discusses scenarios and fact patterns in which the ITC can be more advantageous for brand owners than more traditional court cases.
