Overview
Steptoe's win for the Trustees of Dartmouth College at the US Court of Appeals for the Federal Circuit was covered in a Law360 article titled "Fed. Circ. Affirms PTAB Save Of Dartmouth Patent Claim." The court's decision on March 6 cements Dartmouth's victory based on the January 2019 US Patent and Trial Appeal Board (PTAB) affirmation of the validity of Claim 2 of Dartmouth's US Patent No. 8,383,086. The patent at issue relates to pharmaceutical compositions of nicotinamide riboside. Elysium Health appealed the validity ruling in March 2019 and the Federal Circuit heard oral argument on March 5, 2020.
Steptoe partners John Abramic and Jamie Lucia tried the case before the PTAB and Abramic presented the oral argument at the Federal Circuit.
