Overview
Jamie Lucia is a seasoned litigator representing companies in all phases of high-stakes intellectual property litigation and advising clients on IP issues. Jamie has extensive experience representing clients before district courts, the PTAB, and the ITC, addressing matters involving biotechnology, pharmaceuticals, medical devices, consumer electronics, and business methods. In addition to her experience in patent litigation, Jamie has also litigated antitrust, copyright, trademark, trade secret, and unfair competition matters. Jamie also uses her chemistry background to provide unique insight to her clients in pharmaceutical patent litigation, including infringement disputes under the Hatch-Waxman Act.
Before launching her legal career, Jamie undertook graduate coursework in chemical physics and optics, and was a research chemist at a pharmaceutical company in San Diego.

Representative Matters
- Representing Aquestive against claims of defamation, trade libel, and unfair competition filed by plaintiff Neurelis, Inc. relating to competing products for the treatment of acute repetitive seizures. We successfully dismissed several of Neurelis's original allegations and claims through an anti-SLAPP motion that was appealed to the California Court of Appeal. The case is ongoing.
- Representing Solaria Corporation and Complete Solaria, Inc. in a case pending in the Northern District of California where a competitor accuses our client of several things, including trade secret misappropriation related to mass manufacturing processes for shingled solar modules.
- Represented Aquestive Therapeutics, Inc. in a lawsuit alleging patent infringement by two pharmaceutical products marketed by BioDelivery Sciences, Inc. The settlement agreement included payment of money from BioDelivery Sciences to Aquestive in resolution of the infringement claims and the defendant's counterclaims.
- Represented Trustees of Dartmouth College in an IPR proceeding where Thorne Research, Inc. challenged the validity of a Dartmouth patent related to nicotinamide riboside (NR) pharmaceutical formulations. This was the second time that our team of attorneys successfully defended the challenged patent in an IPR proceeding.
- Represented Hanshow, a Chinese tech company, in a patent litigation matter against its French competitor, SES-imagotag SA, in the US District Court for the Eastern District of Texas. The patents relate to systems and methods used in digitally monitoring product inventory in stores.
- Won summary judgment for Aquestive, an upstream supplier to a pharmaceutical company, in US federal litigation regarding antitrust conspiracy and product-hopping allegations brought by 42 state attorneys general. Our summary judgment motions raised unique issues concerning whether a supplier of innovative technology to a pharmaceutical manufacturer may be held liable as a co-conspirator in the drug company’s efforts to engage in lifecycle management for its products.
- Represented plaintiff Aquestive Therapeutics, Inc. in a lawsuit alleging patent infringement by a generic pharmaceutical product marketed by Alvogen. Aquestive sued Alvogen for patent infringement based on Alvogen's marketing and sale of its generic Suboxone film products (buprenorphine and naloxone). The case was resolved via a settlement and stipulated dismissal of all claims and counterclaims.
- Represented plaintiff Aquestive Therapeutics, Inc. in a lawsuit alleging patent infringement by a generic pharmaceutical product marketed by Dr. Reddy's. Aquestive sued Dr. Reddy's for patent infringement based on Dr. Reddy's marketing and sale of its generic Suboxone film products (buprenorphine and naloxone). The case was resolved via a settlement and stipulated dismissal of all claims and counterclaims.
