Overview
The President issued an executive order on "Securing the Domestic Bulk-Power System." The order includes prohibiting the importation of "bulk-power system electric equipment designed, developed, manufactured, or supplied, by persons owned by, controlled by, or subject to the jurisdiction or direction of a foreign adversary." Steptoe's energy and international trade teams regularly provide regulatory compliance counseling to electricity companies. We would be happy to assist any companies with securing the importation of any goods and equipment that may fall within the terms of this proclamation. Even before that, however, there may be opportunities to assist the Task Force that will be established under this proclamation in the identification of equipment subject to the order, the identification of methods to get equipment and vendors on a qualified list, and relevant factors to implement through future contracts in order to mitigate the risks identified in the proclamation.
