Overview
(October 29, 2021, Washington, DC) – Steptoe has secured a significant trial victory for Qingdao Hollyren Cosmetics Co., Ltd. d/b/a Hollyren (“Hollyren”); Qingdao Xizi International Trading Co., Ltd. d/b/a Xizi Lashes (“Xizi”); and Qingdao LashBeauty Cosmetic Co., Ltd. d/b/a Worldbeauty (“Worldbeauty”) at the US International Trade Commission (ITC). On October 28, the presiding chief administrative law judge of the ITC found that Hollyren, Xizi, and Worldbeauty did not violate Section 337 of the Tariff Act of 1930, because the complainant lacks the required domestic industry and the majority of the accused products do not infringe the asserted patents. The chief administrative law judge also rejected complainant’s request for a general exclusion order and for cease and desist orders to Hollyren, Xizi, and Worldbeauty to the extent that a violation is found.
