Chemical Watch recently quoted Eléonore Mullier and Ruxandra Cana in an article titled, "ECHA appeals board ruling could limit agency's power to request more testing, lawyers say." The article discusses how a decision by ECHA's Board of Appeal (BoA) to annul part of a request for further testing under REACH has "set a benchmark" for drawing conclusions about negative test results.
Speaking about the decision Mullier explained, "The decision clarifies the limits of the agency's power to request further testing during substance evaluation." Those limits may be particularly significant when registrants have provided older test data, which may have been obtained under suboptimal conditions relative to present day scientific approaches, but is nevertheless valid for regulatory risk assessment.
Cana added, "the case may be of wider importance because the BoA had engaged deeply with the science involved," something it has not often done previously.
