Chemical Watch recently quoted Eléonore Mullier in an article titled, "EU Court Dismisses Case Against 'Silanamine'." The article discusses how the EU's General Court has dismissed a legal action brought by Evonik against the European Commission for its harmonized classification and labelling proposal (CLH) of a silica-based substance referred to as "silanamine" by regulatory authorities.
Speaking about the decision Mullier explained, "the court really strongly differentiated based on the hazard class. This case is about STOT RE via inhalation, and the court really went a long way in saying this is not the same as the carcinogenicity or the reproductive toxicity hazard classes." She added that the distinction made by the General Court was "perhaps a little artificial" and that "there should still have been the assessment of intrinsic properties" by the Court, as it did in the titanium dioxide case.
